PCCFA TRANSPARENCY MEMO – THE FACTS

Dear faculty,

With the 2nd filing from CFT for a decertification vote, it’s more important than ever that our response campaign be strong, vocal, visual, and public. We are counting on you to support PCCFA Solidarity so that we can soundly defeat this second attempt at a dismantling of all we’ve fought for and achieved together as a transparent, democratic, independent union. 

FIRST, Please review our Transparency Memo below which responds to erroneous and misleading information from our CFT opponents. WE RESPOND WITH THE FACTS! These talking points, we hope, will help us all have conversations with colleagues and encourage them to vote NO on this second decertification.

ABOUT PCCFA

  •  A non-profit 501C organization;
  •  PCCFA By-Laws and Constitution ratified September 6, 2019 are available at pccfacultyassociation.org ;
  • A petition to amend the PCCFA Constitution by referendum may be initiated by a petition signed by 50% of the membership or by a majority vote of the Executive Board (Constitution Article IX: Amendments, Section 1);
  • We keep on retainer the Law Offices of David Conway and receive consulting from one of the best union lawyers in the state (David Conway).

ABOUT PCCFA DUES

  • Our dues are a flat 1% in Fall and Spring semesters only (no intercession or overload dues);
  • Leadership Board Release Time is not paid from Faculty Dues;
  • Dues pay to compensate a part-timer-focused Vice President position on the Executive Board (part time labor is compensated);
  • Dues pay to compensate Board officers working during out of contract assignment on negotiations, grievances, marketing and research. Officers work 12 months per year.
  • Dues pay two full-time office employees with years of experience in union advocacy and union administrative tasks. Duties include: design and maintain a state of the art, professional website; graphic design; conduct research; maintain banking and accounting records utilizing Intuit Quickbooks; facilitate non-profit tax filing and annual financial audit; consult with faculty 5 business days per week (by appointment during COVID through 2023); organize and facilitate Board elections; create and conduct surveys; maintain a list of active, dues-paying members;
  • Dues pay to fund an official, regulated political action committee (PAC) dedicated solely to electing faculty-supporting PCC Board of Trustees members; (Your money stays local). PAC information publicly available on the internet.

ABOUT PCCFA GRIEVANCE REPRESENTATION

  • 2 Leadership Board Members dedicated to grievance representation on a full-time basis;
  •  Represent faculty at disciplinary hearings and disciplinary meetings
  • Available for 7-days per week consultation;
  • Prepare legal paperwork to file grievances on behalf of individual faculty for contract violations;
  • All PCC faculty are eligible for PCCFA Grievance representation regardless of PCCFA membership status.

ABOUT BOARD ELECTIONS

  • Elections take place in Spring; conducted by an Election Committee of PCCFA members in good standing (Bylaws Article 1 Section 1);
  • If any officer is in a contested race, then that officer shall not participate in the ballot count (Bylaws Article 1, Section 3);
  • Any faculty member (Full time, part time, non-teaching, counseling, library, etc.) can run for our open 1 President position, 3 FA Director positions, 1 Treasurer position, 1 Secretary position. (Constitution Article VI: Officers, Section 1);
  • In addition to the above-named positions, part time faculty may run for our designated Part Time Vice President position. (Constitution Article VI: Officers, Section 1);
  • In addition to the above-named positions, excluding part-timer Vice President, Full Time faculty can run for our designated Full Timer Vice President position; (Constitution Article VI: Officers, Section 1);
  • Voting is by secret ballot. An Election Committee oversees elections and candidates may be present for ballot counting. (Constitution Article VI: Officers Section 2).
  • Recall of an elected PCCFA officer may be initiated by 33% of the membership. (Constitution Article VI: Officers, Section 3).

ABOUT PCCFA FINANCIALS

  • Registered as a Mutual Benefit Corporation (MBC) organized under the Nonprofit Mutual Benefit Corporation Law to protect or promote the interests of members by bargaining collectively with their employers to secure better working conditions, wages, improve the grade of education, and develop a higher degree of efficiency in their respective disciplines;
  • Does not buy and sell stocks; does not buy and sell property;
  • Annual Consolidated Financial Statements available for viewing in the FA Office by appointment with office managers and your elected treasurer;
  • Undergoes an annual financial audit for budget accountability with one of the leading non-profit financial accountants in the state with a career-focus on labor unions (John Pooley, Accountant);
  • Files non-profit taxes and retains service of a certified public accountant (CPA) with years of experience with union accounting (Rita C. Villa Accounting Firm); IRS Non-profit tax filing publicly available on the internet.

ABOUT PCCFA SERVICE BY YOUR BOARD MEMBERS

  • Represent faculty on numerous committees: College Board; College Council; Calendar Committee; Flex Advisory Committee; Budget Resource Allocation committee; Benefits Committee; Board of Trustees Budget Committee; etc.; Hiring Committees for all management positions including President, VPs, and Deans. Reassigned Time hiring committees (such as New Faculty Orientation leaders) etc.; attend and present at Board of Trustees meetings;
  • Compose, revise, edit, and negotiate contract language;
  • Work hours outside of release time allotment 12 months per year for grievances, negotiations, hiring committees, and research.
