Negotiations Update on Distance Education – July 27, 2026

Negotiations continued last week over the increased workload created by ADA and RSI mandates for online instruction.  PCCFA negotiators have consistently raised concerns about the additional labor these mandates require, but the District’s latest proposal fails to address those concerns and instead characterizes the work as part of our existing duties.

Our key concerns with the District’s proposal include: 

  • No Compensation for Faculty: Faculty are required to update their online courses (or lose the right to teach online), but are not entitled to compensation for the increased workload.
  • Permanent Workload Increases: Even after April 2027, faculty would have a new, unpaid and permanent obligation to remediate their courses for accessibility compliance.
  • Faculty Punishment for “Noncompliance”: The District defines this unpaid work as a new professional duty and then states it can discipline faculty for failing to comply.
  • Academic Freedom Concerns: The District reserves the right to remove and replace faculty course materials that are allegedly non-compliant.
  • No Meaningful Intellectual Property Protections: The District wants to control which third-party platforms or vendors receive access to faculty-created materials, but their proposal doesn’t provide enforceable protections to ensure that those materials cannot be reused, distributed, or exploited without faculty permission. 
  • Early Compliance Due Date: The District is demanding that faculty finish this free work before April 2027, a year before the District’s compliance deadline in 2028.
  • Required but Unpaid Training: The District’s proposal creates a mandatory training obligation with no clear limits on time, scope, or frequency and with no compensation provided for the additional labor 
  • No Objective Test for Compliance: The District, and the District alone, determines whether or not a faculty member’s course passes the District’s compliance review, without any set scoring threshold or rubric.
  • Lose Your Online Courses: Any course that does not pass this mysterious test, determined solely by the District, will be taken away from faculty. Faculty “may” then be allowed to teach the course in person (but no promises).

The PCCFA will continue to staunchly defend faculty rights and will not allow these mandates to become a pathway for the District to expand faculty workload, erode faculty autonomy, and shift the institutional responsibilities for these mandates onto faculty shoulders without appropriate recognition and compensation.
