KNOW YOUR CONTRACT: Understanding Paid Jury Duty at PCC

Will I lose pay or have to use my Personal Necessity Leave (PNL) if I have been subpoenaed or called to jury duty ? 

Absolutely not.  Article 6 of the faculty contract indicates that ALL FACULTY – both part-time and full-time faculty – who have been ordered to appear in court for a subpoena or jury duty “shall suffer no monetary loss by reason of this service” (Articles 6.15.1 and 6.15.3).  

Other details and exceptions:

  • Employees must provide PCC with a copy of the subpoena or a certificate of the clerk of the court with the absence report (Articles 6.15.1.2 and 6.15.3.2).
  • Any fees (not including mileage) that the employee receives for a subpoena or jury duty must be paid to PCC “unless the fees are greater than the employee’s salary in which case the employee may retain the fees and be listed as absent due to personal business” (Articles 6.15.1.1 and 6.15.3.1).
  • Paid jury duty is unlimited with one exception.  While on paid jury duty leave, employees must return to work on any days or portions of days on which their service as a juror is not needed and they would otherwise be scheduled to work (Articles 6.15.2 and 6.15.3).  
  • The above right does not extend to employees who are absent due to cases in which they are litigants themselves.  If an employee is required to appear in court as a litigant, the absence can be charged to PNL if the employee so chooses (Articles 6.15.1.3 and 6.15.3.3).
